These terms and conditions outline the rules and regulations for use of the website in accordance with the provisions of the EU Regulation – GDPR 679/2016.
The company that manages the website, hereinafter referred to as balkanperformance.com, is the Company GABA OPTIFARM SRL, hereinafter referred to as the Seller, registered with the Trade Register under no. J08/1072/2018 and having the Unique Registration Code: RO39309037.
Use of this website implies acceptance of the terms and conditions below.

- Copyright
The entire content of the website – images, videos, texts, texts, graphics, symbols, web graphic elements, scripts, programs and other data – is the property of the Seller and its suppliers and is protected by the Copyright Law and by the laws on intellectual and industrial property. The use without the written consent of the Seller of any of the elements listed above is punishable under applicable laws. The Logo is a registered trademark and benefits from the protection of the legislation in force.
You may view and/or print pages from https://balkanperformance.com for personal use subject to the restrictions set out in these terms and conditions.

The Vendor allows all users access to the balkanperformance.com website for personal use, without granting them the right to download or modify or reproduce in whole or in part the website, copy, sell/ resell or exploit the website in any other manner for commercial purposes or contrary to the interests of the Vendor’s company without the Vendor’s prior written consent. Any attempt to access the personal data of another user, to modify the content of the site or to affect the performance of the server on which the site is running, will be considered as an attempt to defraud the site and will trigger criminal investigation against the person or persons who initiated this action.
- Limitation of liability for products and services
Products and services are offered in the form in which they come from the manufacturer and also subject to stock availability. The Seller makes no warranties, express or implied, including but not limited to the operation of this site, the information, content, materials or products on the site, and their fitness for a particular purpose.
Users agree that use of this site and purchase of products or services is at their own risk.
The images published on the site are for presentation purposes only, and the products delivered may sometimes differ from the images presented in any way (color, accessories, appearance, etc.). The Seller and its suppliers reserve the right to modify product specifications without prior notice. The Vendor assumes no responsibility for the descriptions of the products presented on the site, which are identical to those made available to us by the representatives of each brand.
All products are accompanied by the original warranty certificate issued by the Seller in its capacity as direct importer. The maximum amount of damages payable by the Seller to any customer in the event of non-delivery or improper delivery shall be the amount of the amount collected by the Seller from such customer.
All promotions displayed and described on the Website are valid only under the conditions described when the promotion is announced and while stocks last.
- Limitation of price liability
Prices shown include VAT (9%), and include delivery charges, minimum order is 200 RON. The seller reserves the right to change the price for products made to order. The price of products made to order may be influenced by exchange rates or other taxes and excise duties. Stocks may change between the time the order is placed and the time the order is accepted, and for this reason certain products may not be available.
Prices are valid for two days from the date the order is placed, subject to stock availability. Any product that has no price (zero price is displayed) is implied not for sale as it is not in stock.
- Limitation of liability for delivery
Product deliveries are available within Romania and internationally to countries in the European Union, the United Kingdom, and the United States. The Seller reserves the right to verify and confirm orders prior to processing, either through online confirmation by the Customer or via telephone communication.
Transportation costs will be borne by GABA OPTIFARM SRL Free delivery is possible through SAMEDAY or other courier companies. For locations outside of this coverage, additional shipping charges may apply. For more information please visit the delivery and return methods page.
Seller reserves the right to delay or cancel deliveries of ordered products if they cannot be honored for reasons beyond Seller’s control which include: calamities, fires, explosions, floods, epidemics, strikes, governmental actions, wars, acts of terrorism, protests, riots, civil disturbances or other impediments of force majeure, as provided by Romanian law.
Before each delivery the customer will be contacted by the SAMEDAY courier/agent. In case the customer is not found at the mentioned address, within the mutually agreed timeframe, the courier will return once more after re-establishing contact with the customer, at which time, if the parcel is not picked up, the order will be canceled and the product returned to the Seller’s headquarters, the customer will bear both the costs of a new delivery and the costs of the undelivered delivery, regardless of the value of the ordered products.
- Customer obligations for products received as gifts
The products delivered by the Seller as a “gift” are offered as a method of rewarding the customer for the order placed on the Seller’s website. The Customer is aware and acknowledges that the product offered by the Seller as a “gift” is a determining reason for placing an order on the Seller’s website, and undertakes that in the event that the Customer wishes to return the purchased product, the Customer shall return the product received as a “gift” in the condition in which it was received.
In the event that the customer returns the purchased product and wishes to reimburse the amount paid, but does not return the product offered as a “gift”, the Seller is entitled to deduct from the amount returned to the customer the value of the “gift” product at the value shown on the purchase invoice.
- Limitation of liability for payment
Payment for ordered products can be made in advance, by bank transfer or upon delivery of the products – RAMBURS. The Seller reserves the right in certain cases to require payment for the products in advance. Payment in advance may be made by money order, and proof of payment must be sent to the Seller at the email address: office@balkanperformance.com. Delivery will be made only after the money has been paid into the Seller’s account.
Other payment methods:
- Online by bank card through NETOPIA (Visa / Maestro / Mastercard). If you have chosen the “Online by bank card” payment method, you need to fill in a form with your card information on the secure page of the payment processor.
- Payments with Visa and MasterCard (Visa / Visa Electron and MasterCard / Maestro) credit / debit cards are made through the “3-D Secure” system, developed by organizations that provide the same level of security for online transactions as those made at an ATM or in the physical environment at the merchant. “3-D Secure” ensures, first and foremost, that no information related to your card is transferred or stored at any point in time on the store’s servers or the payment processor’s servers, this data is directly entered into the Visa and MasterCard systems.
- Limitation of product warranty liability
The products purchased through this website benefit from the Seller’s warranty issued by virtue of its quality of direct importer, in compliance with the legal provisions in force. Thus, each product will be accompanied by the guarantee and conformity certificate.
- Disclaimer for links to other sites, server, browser
The balkanperformance.com website is hosted on the servers of a third party company. The Seller Company cannot be held responsible for:
- any errors occurring on the site regardless of the reasons for their occurrence, including site changes, settings, or updates;
- for errors occurring due to the use of certain browsers to visit the site.
The Seller is not responsible for the content, quality or nature of websites that can be accessed via links from the Website. For those sites, full responsibility rests with the owners of those sites.
If you find any link on our Web site or on any linked Web site for any reason, you may contact us about it by sending an e-mail to office@balkanperformance.com. We will consider requests to remove links, but will not be under any obligation to do so or to respond to you directly.
- Access and functionality to our website
